Custody Differences In Same-Sex Divorce
One of the major ways that same-sex divorce differs is that child custody is a much different process. The most common complication to custody is children that pre-date a marriage. In many cases, the stepparent takes on a major role in parenting the child. If certain legal steps are not taken early, the custody post-divorce can become a major concern in divorce.
Even though many rights and presumptions in the law of Ohio don’t necessarily differentiate between same sex and opposite-sex couples, they can still face challenges. Which is why we work hard to preserve our clients rights to time with their family.
Ending A Civil Union Or Domestic Partnership
Because of the relative recency of Obergefell v. Hodges, not all same-sex couples living together are necessarily married. Civil unions and domestic partnerships and many other types of marriage “placeholders” were common, and many are still in use.
